JASSU Reisen Data Protection Policy

In this Privacy Policy, Jassu Reisen GmbH (‘Jassu Reisen’) informs you how personal data are collected, processed and used on this site and about the rights data subjects have. As a rule, we will only collect, process and use your personal data where this is allowed under the German Law on Data Protection (Bundesdatenschutzgesetz -BDSG) and the General Data Protection Regulation (GDPR) and national data protection regulations.

A data protection officer has not been appointed, and Jassu Reisen is not obliged under the law to appoint a data protection officer.

The data processing controllers have implemented various technical and organisational measures to guarantee, to the extent possible, consistent protection of the personal data processed on this site. However, there may always be security gaps when data is transferred on the web, and therefore it is not possible to guarantee absolute security. For this reason, you may give us your personal data otherwise, for instance via telephone.

§ 1 Personal Data

Personal data are all data that can be attributed to you as an individual and by which you can be identified (for instance, name, address, email address, user behaviour).

§ 2 Collection and Storage of Personal Data and the Nature and Purpose of its Use

(1) Using and visiting the site to find information

When you use our website only to find information, if you do not register or send information to us otherwise, we will only collect the personal data your browser automatically transfers to our server. Such information is retained only temporarily in what is referred to as a logfile.

If you wish to access our website, we will collect the following data that are recorded without intervention on your part and are retained until they are deleted automatically:

  • IP address of the retrieving computer
  • date and time of request / of access
  • the website via which our website was accessed (referrer URL)
  • time zone difference to GMT
  • content of request (individual page)
  • access status / http status code
  • the quantity of data transferred
  • the website from which the request was made
  • browser / browser type used, your computer’s operating system if relevant, its surface and your access provider's name
  • browser software language and version
  • other similar data and information that may be used to defend any risk to our IT systems in the event of an attack.

We collect the data for the following purposes:

  • to deliver the content of our website correctly
  • to ensure that navigating our website is convenient
  • to evaluate system security and stability
  • to ensure the long-term viability of our IT systems and our website technology
  • to provide law enforcement authorities with the information necessary for criminal prosecution in case of a cyber-attack
  • for other administrative purposes.

Data processing is carried out on the basis of Art. 6(1) sentence 1 (f) of the GDPR. Our legitimate interest follows from the purposes listed above for data collection.

When using these general data and information, we do not draw any conclusions about the data subject. Therefore, we analyse anonymously collected data and information statistically, and with the aim of increasing the data protection and data security of our enterprise, to ensure an optimal level of protection for the personal data we process. The anonymous data of the server log files are stored separately from all personal data provided by a data subject.

We also use cookies on our site. Please find details on cookies in § 5 and below in this Data Protection Policy.

(2) Contacting us via email / contact form

When you contact us via email or by completing the contact form, we will collect from you the required personal data (name, first name, address, email address, telephone number (fixed-line and / or mobile number)) on the web form. We collect and retain these data so that we can identify you as a customer, answer your questions or process your order of a catalogue or your travel booking. Data processing for the purpose of contacting us is prompted by your contact request and is required as per Art. 6(1) sentence 1 (b) of the GDPR for the specified purposes to properly process your non-binding inquiry, order of a catalogue or your booking request and for the mutual performance of obligations under the agency’s agreement.

The personal data entered by the data subject are collected and stored exclusively for internal use by the controller and for own purposes. The controller may request transfer to one or more contract processors that also use personal data exclusively for internal purposes which is attributable to the controller.

By registering on the website of the controller, the IP address, assigned by the Internet service provider (ISP) and used by the data subject, date and time of the registration are also stored. The storage of this data takes place against the background that this is the only way to prevent the misuse of our services, and, if necessary, to make it possible to investigate committed offenses. Insofar, the storage of this data is necessary to secure the controller. These data are not passed on to third parties unless there is a statutory obligation to pass on the data, or if the transfer serves the aim of criminal prosecution.

The registration of the data subject, with the voluntary indication of personal data, is intended to enable the controller to offer the data subject content or services that may only be offered to registered users due to the nature of the matter in question. Registered users are free to change the personal data specified during their registration at any time, or to have them completely deleted from the data stock of the controller.

The data controller will, at any time, provide information upon request to each data subject as to what personal data are stored about the data subject. In addition, the data controller will correct or erase personal data at the request or indication of the data subject, insofar as there are no statutory obligations to retain the data. The entirety of the controller’s employees are available to the data subject in this respect as contact persons at info@jassu-reisen.de.

We collect, process and use the data you give us to enable you to use our web offer (usage data) and insofar as is necessary for the conclusion, implementation or termination of the contract (performance of contract) and for providing customer support. The data are not passed on to third parties without your explicit consent.

(3) Live chat tool Userlike

You can use Userlike on our site. Userlike is a live chat software. The chat is integrated in the source code. This is done using a script. When you use the chat, you automatically use Userlike services. The data collected include: chat history, IP address at the time of the chat and country of origin. These data are not passed on to third parties and are for security and internal statistics only. The data do not serve to identify you as a person. They are not kept. They are deleted after the chat. Deletion of data and storage period:

We will retain your personal data only for as long as this is necessary for the specified purpose (processing your request or contract handling) and for performing the contract. We will delete the data when it is no longer necessary to retain them, or restrict the processing of the data should there be a statutory obligation (Art. 6(1) (c) of the GDPR) to retain the data. The criterion for the duration of storage of personal data is the statutory retention period applicable in the specific case. Upon the expiration of that period, the relevant data are routinely erased, provided they are no longer necessary for contract performance or initiation.

You can object to your data being used or processed for purposes of advertising, market research or opinion polling by sending an email to info@jassu-reisen.de.

In § 4 and below, you will find information on how we may use the services offered by external service providers for individual features of the range of services we offer or use your data for advertising purposes. We also specify the criteria we use to determine retention periods.

Where there is no legal basis for the processing of personal data, we will obtain the consent of the data subject.

§ 3 Your Rights as Data Subject

According to Art. 7(3) of the GDPR, you have

- the right to withdraw your consent to us, wherever you gave consent to data processing, at any time. As a result, we will no longer be authorised to continue the processing of data that was carried out on the basis of your consent (right of withdrawal).

According to Art. 15 of the GDPR, you have

  • the right to be informed about your personal data we process and the purposes of processing, the category of personal data, the recipients or categories of recipients vis-à-vis whom such data have been or will be disclosed, the projected storage period, or about
  • the right to rectification or erasure (right to be forgotten’);
  • the right to restriction of the processing;
  • the right to object to the processing;
  • the right to data portability;
  • the right to know where your data come from if not collected by us;
  • the implementation of automated decision-making including profiling and, where appropriate, the right to request detailed information on its features.

 

According to Art. 16 of the GDPR, you have

  • the right to request that any inaccurate personal data held by us is rectified immediately or incomplete personal data is completed immediately.

According to Art. 17 of the GDPR, you have

  • the right to request that personal data held by us is erased unless the processing of the data is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of the public interest or for the establishment, exercise or defence of legal claims.

According to Art. 18 of the GDPR, you have

  • the right to request that we restrict the processing of your personal data where you challenge the accuracy of the data, where the processing is unlawful but you do not want the data erased while we no longer need the data but you need the data for the establishment, exercise or defence of legal claims, or where you have objected to the processing under Art. 21 of the GDPR.

According to Art. 20 of the GDPR, you have

  • the right to receive your personal data you have provided to us in a structured, commonly used and machine-readable format, or to request that it is transmitted to another controller; and you have the right according to Art. 77 of the GDPR
  • to complain to a data protection supervisory authority about our processing of your personal data. Usually, you can contact the supervisory authority at your usual place of residence or place of work or at the place of our company’s registered office.

Right to object:

Where your personal data are processed on the basis of legitimate interests within the meaning of Art. 6(1) sentence 1 (f) of the GDPR, you are entitled as per Art. 21 of the GDPR to object to the processing of your personal data where the reasons for your objection are related to your individual circumstances. You may assert your right to withdraw your consent or your right to object by sending an email to info@jassu-reisen.de.

§ 4 Transfer of Data to Third Parties

Your personal data are not passed on to third parties for purposes other than those listed below.

We will only pass on your personal data to third parties if:

  • you have given your explicit prior consent under Art. 6(1) sentence 1 (a) of the GDPR;
  • transfer of the data is necessary for the establishment, exercise or defence of legal claims as set forth in Art. 6(1) sentence 1 (f) of the GDPR and there is no reason to assume that you have an overriding legitimate interest that your data is not transferred;
  • there is a legal obligation to transfer the data under Art. 6(1) sentence 1 (c) of the GDPR;
  • it is permitted under the law and it is necessary pursuant to Art. 6(1) sentence 1 (b) of the GDPR to handle contracts with you.

§ 5 Use of Cookies

In addition to the data mentioned in § 2, when you visit our website, information in the form of a cookie is stored on your computer within your browser software and stored there. The use of cookies makes it easier for you to use the website as we will recognize your computer on another visit and thus facilitate the repeated input of data. Cookies are small text files containing setting information that are stored on your hard drive, associated with the browser you use, and by which the organisation placing a cookie (here us) receives certain information.

The cookies we use help us analyse the frequency of use of our site and the number of visitors and enable you to use all our services. Cookies cannot run programmes or transmit viruses to your computer. Cookies are used to make our web offer more user-friendly and effective in general.

This site uses transient cookies and persistent cookies.

Transient cookies are automatically deleted when you close your browser. This includes, in particular, session cookies. Session cookies store a so-called session ID with which different requests from your browser can be assigned to the shared session. This will allow your computer to be recognized when you return to our website. Session cookies are deleted when you log out or close your browser.

Persistent cookies are automatically deleted after a specified period, which can vary depending on the cookie. You can delete the cookies at any time in the security settings of your browser.

The data processed by cookies are necessary for the specified purposes to safeguard our legitimate interests and the legitimate interests of third parties under Art. 6(1) sentence 1 (f) of the GDPR.

You can, however, disable the storing of cookies or configure your browser settings to notify you when cookies are being sent or to automatically delete cookies. You can also delete any stored cookies from your hard drive at any time afterwards.

We would like to point out that if you delete cookies, you will have to expect a limited page presentation and limited user guidance. In principle, however, limited use of our services is possible without cookies.

§ 6 Tracking Tools

The tracking methods outlined below are carried out on the basis of Art. 6(1) sentence 1 (f) of the GDPR. The tracking methods we use are intended to ensure needs-based design and continuous improvement of our site. We also use tracking methods to create statistics on the use of our site and to analyse the statistics for the purpose of improving our offer. These interests are to be considered legitimate interests within the meaning of the regulation mentioned.

The individual purposes of data processing and data categories are specified in the relevant tracking tools.

a) Google Analytics

For the needs-based design and continuous improvement of our site, we use Google Analytics, a web analytics tool by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, United States; ‘Google’). We use that service under a contract data processing agreement.

Google Analytics also uses cookies, text files stored on your computer that make it possible to analyse how you use the site (see § 5 above). The information on how you use the site that is created by the cookie including

- browser type / version

- operating system used

- referrer URL (the site visited before)

- hostname of the accessing computer (IP address)

- time of the server request

are transferred to a Google server in the United States and stored there.

IP anonymization

We have enabled IP anonymization on this site. This means that within the Member States of the European Union or in other contracting states to the Agreement on the European Economic Area, Google will shorten your IP address before transferring it to the United States. Only in exceptional cases will the full IP address be transferred to a Google server in the United States and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on the website activities and to provide further services related to the use of the website and the internet for the website operator. The IP address submitted by your browser through Google Analytics will not be merged with other Google data.

This information may be passed on to third parties where obligatory under the law or where third parties process these data on behalf of another.

Google is registered with the US Department of Commerce’s ‘Safe Harbor’ programme.

In no event will Google associate your IP address submitted as part of Google Analytics with any other data held by Google. IP addresses are anonymized which makes it impossible to associate them (IP masking).

c) Google AdWords und Google Conversion-Tracking

This website uses Google AdWords. AdWords is an online advertising service by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States (‘Google’).

We use conversion tracking in the context of Google AdWords. When you click on an ad from Google, a conversion tracking cookie will be set. Cookies are small text files a browser places on a user’s computer. Cookies expire after 30 days and are not used for personal identification of the user. When the user visits certain pages of this website and the cookie has not yet expired, Google and we can tell that the user clicked on the ad and proceeded to this page.

Each Google AdWords advertiser has a different cookie.  Cookies cannot be tracked using the website of an AdWords advertiser. The information obtained using the conversion cookie is used to create conversion statistics for the AdWords advertisers who have opted for conversion tracking. Customers are told the total number of users who clicked on their ad and were redirected to a conversion tracking tag page. However, advertisers do not obtain any information that can be used to personally identify users. If you do not want to participate in tracking, you can opt-out of this use by easily disabling the Google Conversion Tracking cookie by changing your browser user settings. ‘Conversion cookies’ are stored based on Art. 6 (1) (f) of the GDPR.  The website operator has a legitimate interest in analysing user behaviour to optimize both its website and its advertising activites.

d) Google Tag Manager

This website uses the Google Tag Manager. This service allows website tags to be managed through an interface. The Google Tool Manager only implements tags. This means that no cookies are used, and no personal data are collected. The Google Tool Manager triggers other tags, which in turn collect data if necessary. However, the Google Tag Manager does not access this data. If a deactivation has been made at domain or cookie level, it remains valid for all tracking tags if they are implemented with the Google Tag Manager.

e) GA Audiences

On this website, data is collected and stored by GA Audiences, a web analytics service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States (‘Google’), from which usage profiles are created using pseudonyms. Through this technology, users who have already visited our web pages and online services will see targeted advertising from us on other external pages of the Google Partners Network. To this end, a cookie is placed on your computer with which user behaviour when visiting the website can be analysed and can then be used for targeted product recommendations as well as interest-based advertising.  By storing the cookie, no personal data are stored or processed (see § 5 above). f) DoubleClick

DoubleClick by Google is a service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States (‘Google’). DoubleClick by Google uses cookies to show you ads which are relevant to you. Your browser is assigned a pseudonym identification number (ID) to check which adverts have been displayed in your browser and which adverts have been clicked on. The cookies do not contain personal information. Using the DoubleClick cookies only allows Google and its affiliate websites to display adverts based on previous visits to our or other websites on the internet. To analyse the information generated by the cookies, Google transfers the information to a server in the US where it is stored. Google only transfers the data to third parties due to legal stipulations or as part of contract data processing. On no account will Google merge your data with any other data collected by Google.

g) Google Web Fonts

This site uses Web Fonts provided by Google to uniformly display fonts. When you call up a page, your browser loads the required web fonts into its browser cache to display texts and fonts correctly.

To do this, the browser you are using must have a connection to Google’s servers.  In this way, Google will be informed that our website has been accessed via your IP address. Google Web Fonts are used for a uniform and attractive presentation of our online offers. This is a legitimate interest within the meaning of Art. 6(1) (f) of the GDPR.

This site uses the mapping service Google Maps via an API. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States.

To use the features of Google Maps, it is necessary to save your IP address. This information is usually transmitted to and stored on a Google server in the United States. The provider of this site has no influence on this data transfer.

The use of Google Maps is in the interest of an attractive presentation of our online offers and an easy findability of the places we have indicated on the website. This is a legitimate interest within the meaning of Art. 6(1) (f) of the GDPR.

i) Conversion tracking using the Facebook visitor action pixel

With your consent, we use the ‘visitor action pixel’ from Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, United States (‘Facebook’) within our website. This allows us to track the activity of users after they have seen or clicked on a Facebook ad. This allows an analysis of the effectiveness of Facebook ads for statistical and market research purposes. The data collected in this way is anonymous to us; this means that we do not see the personal data of individual users. However, the data is stored and processed by Facebook. We inform you about this to the best of our knowledge. § 7 Social Media Plug-Ins

Based on Art. 6(1) s. 1 lit. f of the GDPR, we use Facebook and YouTube social plugins on our site and, upon the client's consent, show YouTube videos to increase our company's profile. The promotional purpose behind this is to be considered a legitimate interest within the meaning of the GDPR. The respective provider must ensure that the operation is compliant with data protection law. We have integrated these plugins using the double click method to protect the visitors of our website to the best possible extent.

a) Facebook Social Plug-Ins

Our website uses social plugins (‘plugins’) for the social network facebook.com, operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, United States (‘Facebook’). The plugins can be recognized by one of the Facebook logos (white ‘f’ on blue tile / ‘thumb up’ sign) or the words ‘Facebook Social Plugin’. When you access a page of our website that contains such a plugin, your browser will create a direct connection to the Facebook servers. Facebook will directly transfer the content of the plugin to your browser and embed the content into the website. Therefore, we do not have control over the scope and content of the data Facebook collects using the plugin and inform you to the best of our knowledge (Facebook provides information here: https://www.facebook.com/help/186325668085084).

In the process of embedding the plugin, Facebook will be informed that you or your browser accessed the corresponding page of our website. If you are logged into Facebook, Facebook can associate your visit with your Facebook account. If you interact with the plugins, for example by clicking on the like or share button or by leaving a comment, the corresponding information will be transferred directly by your browser to Facebook and stored there. Furthermore, the information will be published on Facebook and made visible to your Facebook friends.

Facebook may obtain your IP address and save it there even if you are not a Facebook member.

Facebook can use this information for advertising purposes, market research and for making improvements to Facebook pages.
